China will continue to impose anti-dumping duties on imported carbon steel fasteners originating in the European Union and the United Kingdom

On June 28, 2010, the Ministry of Commerce issued announcement No. 40 of 2010, deciding to impose anti-dumping duties on imported carbon steel fasteners originating in the European Union, with the tax rate of 6.1% to 26.0%. On September 9, 2011, the Ministry of Commerce issued announcement No. 56 of 2011, deciding that camax Co., Ltd. will inherit the 6.1% anti-dumping tax rate and other rights and obligations applied by Rudolph Kellerman Co., Ltd. of camax factory in the anti-dumping measures for carbon steel fasteners. On June 28, 2016, the Ministry of Commerce issued announcement No. 24 of 2016, deciding to continue to impose anti-dumping duties on imported carbon steel fasteners originating in the European Union from June 29, 2016 for a period of five years. On September 19, 2017, the Ministry of Commerce issued announcement No. 50 of 2017, which adjusted the anti-dumping tax rate applicable to carbon steel fasteners imported from Royal nedysrov Holdings Limited, nedysrov altner Co., Ltd., nedysrov Barcelona Co., Ltd., nedysrov helmund Co., Ltd., nedysrov bergingen Co., Ltd. and nedysrov frolawton Co., Ltd. from 26.0% to 5.5%.

On January 29, 2021, the Ministry of Commerce issued announcement No. 3 of 2021. According to the announcement, after the end of the brexit transition period on December 31, 2020, the trade remedy measures previously implemented for the EU will continue to apply to the EU and the UK, with the implementation period unchanged; After that date, the newly initiated trade remedy investigation and review cases of the EU will no longer be handled by the UK as a member state of the EU.

On June 28, 2021, in response to the application of China’s carbon steel fastener industry, the Ministry of Commerce issued announcement No. 14 of 2021, deciding to conduct a final review and investigation of the anti-dumping measures applicable to imported carbon steel fasteners originating in the European Union and the United Kingdom from June 29, 2021.

The Ministry of Commerce investigated the possibility of continued or repeated dumping of imported carbon steel fasteners originating in the European Union and the United Kingdom and the possibility of continued or repeated damage to China’s carbon steel fastener industry if the anti-dumping measures were terminated, and made a review ruling in accordance with Article 48 of the anti dumping regulations of the people’s Republic of China (hereinafter referred to as the anti dumping regulations) (see Annex). The relevant matters are hereby announced as follows:

1. Reexamination decision

The Ministry of Commerce ruled that if the anti-dumping measures are terminated, the dumping of imported carbon steel fasteners originating in the European Union and the United Kingdom against China may continue or recur, and the damage caused to China’s carbon steel fastener industry may continue or recur.

2. Anti dumping measures

According to Article 50 of the anti dumping regulations, the Ministry of Commerce made a proposal to the Tariff Commission of the State Council to continue to implement the anti-dumping measures based on the investigation results. The Tariff Commission of the State Council made a decision based on the proposal of the Ministry of Commerce to continue to impose anti-dumping duties on imported carbon steel fasteners originating in the European Union and the United Kingdom for a period of five years from June 29, 2022.

The scope of products subject to anti-dumping duties is the products to which the original anti-dumping measures apply, which is consistent with the product scope in the Announcement No. 40 of the Ministry of Commerce in 2010. The details are as follows:

The name of the investigated product: carbon steel fasteners (English Name: certain iron or steel fasteners), including wood screws, self tapping screws, screws and bolts (whether with nuts or washers, but excluding the screws used to fix the rail and the screws and bolts whose rod diameter does not exceed 6mm) and washers. The investigated products do not include nuts and fasteners used for the maintenance and repair of civil aircraft.

This product is classified in the import and export tariff of the people’s Republic of China (2022) 73181200, 73181400, 73181510, 73181590, 73182100, 73182200, 90211000, 90212900 [1].

The tax rate of imposing anti-dumping duties is consistent with the provisions of Announcement No. 40 of 2010, Announcement No. 24 of 2016, Announcement No. 50 of 2017 and Announcement No. 3 of 2021 of the Ministry of Commerce.

The rates of anti-dumping duties levied on companies are as follows:

EU companies:

8. Other EU companies 26.0%

3. Methods of imposing anti-dumping duties

From June 29, 2022, when importing carbon steel fasteners originating in the European Union and the United Kingdom, import operators shall pay corresponding anti-dumping duties to the customs of the people’s Republic of China. The anti-dumping duty is calculated and levied ad valorem at the duty paid price approved by the customs, and the calculation formula is: anti dumping duty = customs duty paid price × Anti dumping duty rate. Import value-added tax shall be levied ad valorem at the customs value plus tariff and anti-dumping duties.

4. Administrative reconsideration and administrative litigation

According to the provisions of Article 53 of the anti dumping regulations of the people’s Republic of China, those who are not satisfied with the decision of this review may apply for administrative reconsideration according to law or file a lawsuit in the people’s court according to law.
